How Workers’ Compensation Works

  1. To qualify for workers’ compensation lost wage benefits, you must be unable to work for five or more days due to an on-the-job injury. The statute of limitations gives you four years to file your claim in Massachusetts. However, we encourage you to retain a lawyer as soon as possible to ensure that your rights are protected and you are getting all the benefits you deserve.
  2. Payment without prejudice allows insurance companies to pay injured workers for up to 180 days without formally accepting liability. You should contact a workers’ compensation attorney such as Michael J. Reno if you have received a request to extend that 180 day period.
  3. Workers’ compensation entitles you to medical treatment. It also entitles you to wage benefits equaling up to 60 percent of your average weekly wage. These wage benefits can last up to three years. At the conclusion of the three-year period, if the injured worker is not permanently disabled, the wage benefits may be reduced.
